Public Health Law Assignment Help

Use what you have read about public health law to support your response to the following:

1. If you support bans such as this, what argument do you use to justify your position? If your stance is to go even further and propose a total ban on all smoking (making smoking illegal), do you support banning everything that poses a risk to the public health and/or safety? If not, how do you justify banning one risk to the public health and safety while choosing not to ban something else?

2. If you do not think this ban (or similar) should have been enacted, what argument would you use to justify your position?

3. If you see merit to both sides, can you describe a potential compromise that would benefit public health while preserving individual rights?

4. Consider other risk reduction initiatives: seat belt laws, helmet laws, posting calories on menus, forcing states to adopt 21 years as the legal drinking age, or warnings on cigarette packages, for example. Are these protecting society or an intrusion of the “nanny state”?

1. I support the law, since the exposure to second-hand smoke is considered unsafe by the US Surgeon General, (Jamal et al 2018). The exposure of a healthy non-smoker to smoke results into red eyes, headaches, hoarseness, and even some coronary disease like respiratory problem and lung cancer. It is also evident that children face asthma, respiratory infection, ear infection and lung impairment problem from parental smoking habit. According to Homa et al (2015), this ban is more likely to make the adults quit their smoking habit. Additionally, researcher suggests that second hand smoke leads to reduced infant birthweight to 2.5kg and creates respiratory issues among children. I agree with the decision to ban everything in public places which can create hazard to public health, such as banning diesel car.

2. In my opinion, this ban should not have been enacted in New York city (NYC) as it can create problem for the tourists. The tourists who visit NYC for the first time and are unware of this law can ruin their trip and might face legal consequences. Based on the Smoke Free Air Act, smoking has been considered illegal in both indoor places (clubs, restaurants, bars) as well as outdoor places (beaches, pools, parks), which are the most tourist visited places (Holgate 2017). They can even find themselves in trouble with police and pay high taxes. In a way, this can lead to promote negative image of NYC among the tourists and decrease its value at the forefront of global tourism industry.

3. With the increase in implementation of various anti-smoking laws, there exists one potential compromise and it is the installation of outer smoking lounge in every open outdoor public places. These lounge holds ash handling system, freestanding and fireproof system. Additionally, smoking zones can be also created in public buildings like airport, shopping malls and offices. Introducing such systems can help in containing cigarette smoke within it and minimum exposure to non-smokers. These rooms are fitted with smoke extractors and provide fresh air to breath in. These rooms can hold a maximum of five people with a regular monitoring (McNeil et al 2015).

4. I personally support these risk reduction initiatives and bans on public of NYC. It is evidenced that after the banning of mobile phones for school students (aged 16 years), there has been a remarkable improvement in their academic performance by 16 percent. Similarly, the New York City has also increased the legal age of cigarette purchase from 18 to 21 years and made it illegal for merchants to sell tobacco beyond 21 year aged customer. However, this ban also showed an unbelievable decline in smoking rate, as most of smokers start this habit from this critical age. According to survey, most of the cigarette smoker have got addiction before the age of 21 (Berman and Kim 2015).
